Yoos, wearing an orange reflective vest and bicycling home late on the evening of June 1, 2011 -- after his volunteer shift at the Capitol Theater -- was stopped by an officer of the Olympia Police Department as he was throwing paper towels into a city-owned dumpster adjacent to Twisters Donuts, 2302 Fourth Ave. He was originally cited for criminal trespass and obstructing justice, but one of the officers called to the scene filed a report 3-1/2 weeks after the incident alleging that Yoos had kicked him. This would constitute a felony, and the case, formerly being heard in the Olympia City Municipal Court, was bumped up to the Thurston County Superior Court.
