Motion to Dismiss Hearing to be continued...

Wednesday 19 December 2012, Thurston County Courthouse—
Pre-trial motion to dismiss was heard today, Judge Christine Pomeroy, retired, pro-tem, ran an orderly court room. Scott took the stand for nearly two hours. The hearing required more than 3 hours, and will be continued. The defense will have a chance to re-direct. And then the prosecution will have an opportunity to call its witnesses to testify.

Here are a few of Scotty's large cadre of supporters. About 15 or 20 supporters joined Scott and his legal team in the courtroom today. Some of the signs people held were seen to read, "Scott is not a criminal!!!" "Citizen review board now!" "Stop wasting our tax $$" "Justice for Scotty Yoos!" "No more police brutality," "Who polices the police," and "Oly Police are not above the law."

Hearing Postponed, until next week

Yesterday's hearing was postponed because all interpreters were unavailable. Janine Unsoeld posted an article about the situation, here.

The hearing was re-scheduled for Wednesday the 19th, December 2012 at 1:30 PM.

There will be a traditional pre-hearing support vigil starting at 12:30 PM.

Let's hope charges will be dropped, so everyone can save face.

More information: Yoos, wearing an orange reflective vest and bicycling home late on the evening of June 1, 2011 -- after his volunteer shift at the Capitol Theater -- was stopped by an officer of the Olympia Police Department as he was throwing some damp paper towels in a city-owned dumpster adjacent to Twisters Donuts, 2302 Fourth Ave. He was originally cited for criminal trespass and obstructing justice, but one of the officers called to the scene filed a report 3-1/2 weeks after the incident alleging that Yoos had kicked him. This constitutes a felony, and the case, formerly being heard in the Olympia City Municipal Court was bumped up to the Thurston County Superior Court.

Update: Tomorrow's hearing is still on, + an appeal for donations!

Tomorrow's Hearing:
The hearing scheduled for tomorrow morning is still on. Scheduled to start at 9 AM, and rumor has it that Scott's case is listed to go first. Don't forget to vigil in the cool misty morning air starting at 8:15. Can't miss it!

Latest Report, Early November

Latest Report, in the words of Scott:
On Weds., 10/17, Scott Yoos and a healthy cadre of supporters returned to the County Courthouse; (this time WITH the assistance of Scott's much-valued Attorney, Larry Hildes, -who travels with here with his wife/Legal Assistant, Karen; clear down from Bellingham, WA... some 3+ hrs. distant!)   Prior to this latest Hearing, Atty. Hildes had submitted a well-reasoned "Motion to Dismiss" to the Court, and he came prepared to argue for an official Dismissal of the charges against Scott.  The (Persecuting/)Prosecuting Attorney, Andrew Toynbee, requested more time to examine this first Motion, so, a new Hearing date was set for the Motion Hearing, ...November 26th, 2012, (the Monday after Thanksgiving).  The time has yet-to-be-set, but presumedly, the Hearing will begin at 9am, (again @ the Thurston County Courthouse, at 2000 Lakeridge Drive SW in Olympia).  *Watch the blogspot for updates, but (barring unanticipated changes), there will be another pre-Hearing Support Vigil (with signs and such) starting at around 8:15 am. (Please come well-dressed for the weather!)  On the current schedule, we're now anticipating another pre-Trial hearing on 12/12, and the Trial itself should begin in February, 2013.  (It is anticipated to last a week or more.) 
 Excitingly, Atty. Hildes let Scott & his supporters know that he is now in conversation with the Federal Department of Justice regarding this case, and they have expressed a keen interest in possibly pursuing it further.   Larry has also suggested that "Letters" to 'those other papers' (...yes, even The Daily Zero & other print media!) may prove beneficial in nudging this Case towards a just, positive outcome.

 Letters to the elected County Prosecutor (Andrew Toynbee) & to Scott's Prosecuting Attorney (Jon Tunheim) could also be worthwhile.  Both of these gents are reachable at: 2000 Lakeridge Dr. SW,  Building 2, Olympia, WA 98502.
(Hokey as it may seem to some, Scott still  remains fairly-convinced that prayers & good wishes make a difference, too!)
 AGAIN, we'll look forward to seeing as many of y'All as can make it, at the next Motion Hearing, on Monday, (11/26th) at 8:15 or 9am!
 At the close of our meeting, Scott repeated his heartfelt thanks for the community's continued love and support.

Pre-pre-trial vigil / rally

Pre-trial is scheduled for 10:30 a.m. this Wednesday, the 3rd. We'll hold a vigil/ rally, meeting before hand, starting at 9:30 a.m. to raise awareness about this waste of resources to prosecute Scott, who is not a criminal. 

Please gather and demonstrate for disability justice. 9:30 a.m. at the County Courthouse. "Scott is not a criminal. Stop wasting our tax dollars!"

Next Trial Dates

Now updated with  pre-pre-trial vigil information:

An Omnibus (pre-trial) hearing is scheduled for Wednesday 3 October at 10:30am. Vigil at 9:30am.

Status Conference is scheduled for Wednesday, Halloween day, the 31st of October, at 9am. 

Trial is set for Monday, 5 November. 

All dates are 2012. Location is same as usual, Thurston County Superior Court, 2000 LAKERIDGE DRIVE SW, BLDG 2

Pretrial Reportback

Pretrial happened yesterday. There were about 20 people in attendance to support Scott as the Prosecutor continues to press ahead. The following are the words of Scott, with more details about yesterday's hearing, and what's next:
...A big THANKS to all those Friends who crawled outta bed earlier-than-usual this mornin',
(Monday, 7/16), in order to attend & support my much-touted, pre-Trial, "Omnibus Hearing"!
(-Thanks ALSO for those of yous who sent your good thoughts, either psychically or written, wishing me a swift & just outcome to this zany legal mess! ...*IF you haven't got a clue about what I'm ramblin-on about, PLEASE take a look-see @ our new blog: www.scottysupport.blogspot.com ) !

-Disappointingly (but NOT surprisingly), the Prosecutor was unwilling to back-down on the State of Washington's efforts to paint me as a "violent Felon".
At present, they're still galumphing forward with this (what's sure to be a "showcase") Trial.

Due to some unavoidable, out-of-state scheduling-conflicts for Larry & Karen (my Atty. & his partner), we were granted (yet ANOTHER) "Continuance", so NOW, it's likely that we're lookin'
at the actual Trial occurring in late-Sept. or Oct. (of 2012).
-Sorry, but we're currently unsure when my NEXT Pre-Trial Hearing will be scheduled! Please, stay tuned,

This big event is (again) being held @ the Thurston County Courthouse, which is (still) located @: 2000 Lakeridge Drive in Olympia.
